By visiting and/or using any part of Nuts for Anime Figures (aka "NAF"), you agree to all Terms of Use stated below. If you do not agree with these Terms, please close the browser and leave the site. Private Policy: you have read NAF's private policy statement, and consent to all terms listed therein. You agree that NAF shall not be liable for the privacy practices and/or content of third party websites. Affiliations: NAF has no control over vendors, manufacturers, and other third parties mentioned at the NAF website, and you agree that NAF cannot be held responsible for any transaction between you and the other party. NAF Forum: registration and participation in NAF forums is voluntary, and your conduct is bound by the NAF forum rules. Furthermore, you consent to be bound by the terms of service of ProBoards, provider of the NAF forums. Intellectual Property: all images, characters, product names and descriptions are the intellectual properties of their respective owners. All Japanese anime figure reviews published at NAF are copyrighted by NAF, and accompanying images are copyrighted by their respective creators. Nuts for Anime Figures claim the right to create and publish these reviews and accompanying images under the fair use exception for criticisms and commentaries of the copyrighted works. Any visitor of NAF is granted permission to email, print a physical copy, and/or create a pdf file of any Japanese anime figure review published at NAF, so long as the reproduction is for personal use and the review is not altered in any way, shape, or form. Retailers, manufacturers, and media (in any form whether print or electronic) are granted permission to quote from any review published at NAF, so long as the quote is attributed to "Nuts for Anime Figures." Any other original content published at NAF (including special articles and news initially reported at NAF) are copyrighted by NAF, and subject to the same permissions and restrictions for reproductions. Submissions: all submissions (with the exception of images submitted as part of review submission) become the property of NAF, and NAF may publish any materials free of charge and provide permission to republish the materials in any medium whether physical or electronic. Any images submitted are copyrighted by the owners of the images, but NAF receives, by virtue of the act of submission to NAF, a license to publish the images in any manner that the accompanying review submissions are published. By making a submission to NAF, you certify that the submission is your intellectual property and no one else's. Your submssion shall not contain viruses or any other harmful elements that are designed to interrupt, destroy, or limit the functionality of any software, hardware, servers, or other equipment. You agree to indemnify NAF for any violation of these Submissions provisions. Disclaimer of Warranties:all materials provided at this site are "as is," with no warranties of any kind, whether expressed or implied. NAF disclaims all warranties, including but not limited to warranties of merchantability or fitness for a particular purpose. Furthermore, NAF makes no representations as to child safety of any product mentioned at its website; please contact the manufacturer regarding child safety of any product mentioned at NAF. Under no circumstance shall NAF be liability to any party for information contained on this website, or services provided through this website. Choice of Law, Forum, Venue, Jurisdiction, Invalidity of Separable Provisions, Damages, Entire Agreement: NAF is wholly owned by Antony Chow, with its principal office in the County of Queens in the State of New York. Any legal action (including claim for defamation and/or intellectual property violation) where Nuts for Anime Figure and its webmaster are parties to MUST be brought to New York State Supreme Court, Queens County, a court of general jurisdiction that has jurisdiction over out-of-state defendants through New York's long arm statutes. These Terms of Use shall be interpreted and governed by the law of the State of New York. If any provisions in these Terms of Use are found to be invalid for any reason, the rest of the provisions shall remain in force, and any invalid provision shall be treated as if it was never part of the Terms of Use. No party shall use artful pleading to avoid these Terms of Use provisions and bring any legal action where NAF and its webmaster are parties to to a legal forum other than NYS Supreme Court, Queens County. By violating these Terms of Use, you agree to compensate Nuts for Anime Figures and its webmaster in the amount of SEVENTY-FIVE THOUSAND DOLLARS ($75,000.00) as reasonable compensation for appearing in a foreign jurisdiction to have the legal action properly brought back to NYS Supreme Court, Queens County. Such compensation includes the cost of obtaining legal counsel in the foreign jurisdiction and travel expenses. These Terms of Use contain the entire understanding between you and Nuts for Anime Figures with respect to its subject matter. Modification: The NAF Terms of Use may be modified at any time. Any such modification will be noted on the frontpage/welcome page of the website to provide notice to visitors. Such modification will also be italicized on the Terms of Use page of NAF for a period of up to seven days.
